Amend the amendment in section 1 in §8308 in subsection 1 in paragraph C by striking out all of subparagraphs (5) and (6) and inserting the following:

(5) Member dues deduction; and

Amend the amendment in section 1 in §8308 in subsection 1 in paragraph C in subparagraph (7) in the first line (page 2, line 4 in amendment) by striking out the following: " (7)" and inserting the following: ' (6)'

Amend the amendment in section 1 in §8308 in subsection 1 in paragraph C in subparagraph (7) in the 2nd line (page 2, line 5 in amendment) by striking out the following: " (6)" and inserting the following: ' (5)'

Amend the amendment in section 1 in §8308 in subsection 3 by striking out all of paragraph E and inserting the following:

E Unless prescribed or controlled by federal law or regulation, the State and the collective bargaining agent of family child care providers may agree through negotiations to deduct membership dues from child care subsidy payments. A family child care provider who is not a member of the organization of the collective bargaining agent may not be charged a representation fee, service fee or fee of any other kind. A fee may not be charged against the subsidy payment of a family child care provider without the consent of that family child care provider.

Amend the amendment by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

summary

This amendment provides that a family child care provider who is not a member of the organization of the collective bargaining agent may not be charged a representation fee, service fee or fee of any other kind. It further provides that a fee may not be charged against the subsidy payment of a family child care provider without the consent of that family child care provider.
