Resolve, To Require the Department of Health and Human Services To Provide Appropriate Cost-of-living Adjustments for Certain Assisted Housing and Medical and Remedial Private Nonmedical Institutions

Sec. 1. Cost-of-living adjustments for certain assisted housing and medical and remedial private nonmedical institutions. Resolved: That, notwithstanding any other provision of law, the Department of Health and Human Services shall provide cost-of-living adjustments in fiscal year 2008-09 to medical and remedial private nonmedical and assisted housing institutions that are reimbursed room and board costs under the sections of the department's rules entitled "Principles of Reimbursement for Residential Care Facilities - Room and Board Costs" (10-144 Ch. 115) or under rules entitled "Private Non-medical and Remedial Facilities," Appendix C, Medical and Remedial Service Facilities and Appendix F, Non-case Mixed Medical and Remedial Services (10-144 Ch. 101, Ch. III, Section 97) or under 10-144 Ch. 101, Ch. II and Ch. III, Section 6 in the amount of 2%, as applied to all components of the reimbursement rate except the fixed cost component, per year per facility; and be it further

Sec. 2. Appropriations and allocations. Resolved: That the following appropriations and allocations are made.
