Item 2
Bill Tracking Chamber Status

Amend the bill by inserting before the enacting the clause the following:

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  the Department of Education is currently in the process of adopting proposed amendments to Chapter 118: Support Systems: Standards and Procedures for Operation, a routine technical rule of the Department of Education that was originally adopted on July 1, 1988; and

Whereas,  educators and education administrators strongly oppose the proposed changes to the rule and believe that this rule should be designated as a major substantive rule due to the significant issues that are addressed in the rule; and

Whereas,  this legislation, which designates this rule as a major substantive rule, needs to take effect immediately; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Amend the bill by inserting after section 2 the following:

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.
