An Act Regarding Prescription Drug Expiration Dates

Be it enacted by the People of the State of Maine as follows:

Sec. 1. Rulemaking. By January 1, 2008, the Department of Professional and Financial Regulation, Maine Board of Pharmacy shall adopt rules regarding the attachment of expiration dates to prescription drugs dispensed by pharmacists. The rules must provide protection for patients and may allow use of the drugs only to the date supported by the highest standards of pharmacology and scientific research. Rules adopted pursuant to this section are routine technical rules as defined by the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.

This bill directs the Department of Professional and Financial Regulation, Maine Board of Pharmacy to adopt routine technical rules by January 1, 2008 regarding the attachment of expiration dates to prescription drugs dispensed by pharmacists, providing protection for patients and allowing use of the drugs only to the date supported by the highest standards of pharmacology and scientific research.
