Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 29-A MRSA §2395, sub-§4, as amended by PL 1999, c. 600, §1, is
further amended to read:

 
4. Designation by counties and municipalities. County
commissioners and municipal officers may designate public ways
other than those in subsection 3 and impose restrictions within
their respective jurisdictions similar to those made by the
Department of Transportation under subsection 3. Any vehicle
delivering home heating fuel and operating in accordance with a
permit issued by the Department of Transportation pursuant to
this section traveling with a load necessary to provide goods or
services to a site located on or served by that public way may
travel over any county or town way without with a specific
municipal or county permit. A municipality may impose additional
restrictions for home heating fuel delivery trucks a vehicle
traveling with a load necessary to operate provide goods or
services to a site located on a public ways way within that
municipality but may not require a permit for home heating fuel
delivery trucks to operate according to those restrictions.

 
Sec. 2. 29-A MRSA §2395, sub-§9 is enacted to read:

 
9.__Permits.__Municipal officers may require permits for
vehicles to operate on posted roads, either seasonally or for
single use, as long as the permits are available during normal
municipal office hours.__Permits may also be made available by
electronic means through a law enforcement agency for a fee.__A
municipality may charge and retain a fee for the permit, subject
to fee guidelines established by the Department of
Transportation, based upon the weight or value of the load the
vehicle is transporting.

 
SUMMARY

 
The bill allows municipalities to issue permits for vehicles
to operate on any roads that may be posted. A municipality may
charge a fee for the permit subject to guidelines set by the
Department of Transportation.
